{"id":500,"date":"2023-01-18T14:53:17","date_gmt":"2023-01-18T14:53:17","guid":{"rendered":"https:\/\/services.nhslothian.scot\/learningdisabilities\/adults-with-incapacity\/"},"modified":"2023-01-18T15:09:35","modified_gmt":"2023-01-18T15:09:35","slug":"adults-with-incapacity","status":"publish","type":"page","link":"https:\/\/services.nhslothian.scot\/learningdisabilities\/adults-with-incapacity\/","title":{"rendered":"Adults With Incapacity"},"content":{"rendered":"\n<h3 class=\"wp-block-heading\">Adults with Incapacity (Scotland) Act 2000<\/h3>\n\n\n\n<p>Consent: a patient of or over the age of 16 years is presumed under Scottish law to have legal capacity to consent to treatment unless he or she:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>is unable to take in and retain the information material pertaining to the decision, especially as to the likely consequences of having or not having the treatment; and\/or<\/li>\n\n\n\n<li>is unable to weigh the information in the balance as part of a process of arriving at the decision<\/li>\n<\/ul>\n\n\n\n<p>Principles of the Act &#8211; the treatment should:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>benefit the person;<\/li>\n\n\n\n<li>be the minimum necessary intervention;<\/li>\n\n\n\n<li>take account of past and present wishes of patient;<\/li>\n\n\n\n<li>restrict the patient&#8217;s freedom as little as possible;<\/li>\n\n\n\n<li>the patient should be encouraged to exercise any residual capacity; and relevant others (e.g. GP, relatives, carers) should be consulted.<\/li>\n<\/ul>\n\n\n\n<p>Capacity: In order to give informed consent, the patient needs to be capable of:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>acting on decisions;<\/li>\n\n\n\n<li>making decisions;<\/li>\n\n\n\n<li>communicating decisions;<\/li>\n\n\n\n<li>understanding decisions;<\/li>\n\n\n\n<li>retaining the memory of decisions.<\/li>\n<\/ul>\n\n\n\n<p>Remember, a patient may have capacity in relation to simple treatments, but not understand complex treatment (e.g. surgery).
